Withholding or withdrawing life-saving ventilators can become necessary when resources are insufficient. In the USA, such rationing has unique social justice dimensions. Structural elements of dominant allocation frameworks simultaneously advantage white communities, and disadvantage Black communities—who already experience a disproportionate burden of COVID-19-related job losses, hospitalisations and mortality. Using the example of New Jersey’s Crisis Standard of Care policy, we describe how dominant rationing guidance compounds for many Black patients prior unfair structural disadvantage, chiefly due to the way creatinine and (...) life expectancy are typically considered.We outline six possible policy options towards a more just approach: improving diversity in decision processes, adjusting creatinine scores, replacing creatinine, dropping creatinine, finding alternative measures, adding equity weights and rejecting the dominant model altogether. We also contrast these options with making no changes, which is not a neutral default, but in separate need of justification, despite a prominent claim that it is simply based on ‘objective medical knowledge’. In the regrettable absence of fair federal guidance, hospital and state-level policymakers should reflect on which of these, or further options, seem feasible and justifiable.Irrespective of which approach is taken, all guidance should be supplemented with a monitoring and reporting requirement on possible disparate impacts. The hope that we will be able to continue to avoid rationing ventilators must not stand in the way of revising guidance in a way that better promotes health equity and racial justice, both to be prepared, and given the significant expressive value of ventilator guidance. We respond to recent comments on our proposal to improve justice in ventilator triage, in which we used as an example New Jersey’s publicly available and legally binding Directive Number 2020-03. We agree with Bernard Lo and Doug White that equity implications of triage frameworks should be continually reassessed, which is why we offered six concrete options for improvement, and called for monitoring the consequences of adopted triage models. We disagree with their assessment that we mis-characterised their Model Guidance, as (...) included in the NJ Directive, in ways that undermine our conclusions. They suggest we erroneously described their model as a two-criterion allocation framework; that recognising other operant criterion reveals it ‘likely mitigate[s] rather than exacerbate[s] racial disparities during triage’, and allege that concerns about inequitable outcomes are ‘without evidence’. We highlight two major studies robustly demonstrating why concerns about disparate outcomes are justified. We also show that White and Lo seek to retrospectively—and counterfactually—correct the version of the Model Guideline included in the NJ Directive. However, as our facsimile reproductions show, neither the alleged four-criteria form, nor other key changes, such as dropping the Sequential Organ Failure Assessment score, are found in the Directive. These points matter because our conclusions hence stand, because the public version of the Model Guidance had not been updated to reduce the risk of inequitable outcomes until June 2021 and NJ’s Directive still does not reflect these revisions, and, hence, represents a less equitable version, as acknowledged by its authors. We comment on broader policy implications and call for ways of ensuring accurate, transparent and timely updates for users of high-stakes guidelines. (shrink)

In this paper we report on our experiences with using network analysis to discern and analyse ethical issues in research into, and the development of, a new wastewater treatment technology. Using network analysis, we preliminarily interpreted some of our observations in a Group Decision Room session where we invited important stakeholders to think about the risks of this new technology. We show how a network approach is useful for understanding the observations, and suggests some relevant ethical issues. We argue that (...) a network approach is also useful for ethical analysis of issues in other fields of research and development. The abandoning of the overarching rationality assumption, which is central to network approaches, does not have to lead to ethical relativism. (shrink)

In an adaptive clinical trial , key trial characteristics may be altered during the course of the trial according to predefined rules in response to information that accumulates within the trial itself. In addition to having distinguishing scientific features, adaptive trials also may involve ethical considerations that differ from more traditional randomized trials. Better understanding of clinical trial experts’ views about the ethical aspects of adaptive designs could assist those planning ACTs. In spite of advances in medicine and public health, malaria and other mosquito‐borne diseases are on the rise worldwide. Although vaccines, genetically modified mosquitoes and safer insecticides are under development, herein we examine a promising new approach to malaria control through better repellents. Current repellents, usually based on DEET, inhibit host finding by impeding insect olfaction, but have significant drawbacks. We discuss how comparative genomics, using data from the Anopheles genome project, allows the rapid identification of members of three protein (...) classes critical to insect olfaction: odorant‐binding proteins, G‐protein‐coupled receptors, and odorant‐degrading enzymes. A rational design approach similar to that used by the pharmaceutical industry for drug development can then be applied to the development of products that interfere with mosquito olfaction. Such products have the potential to provide more complete, safer and longer lasting protection than conventional repellents, preventing disease transmission by interrupting the parasite life cycle. This article examines the relation between policies concerning Corporate Social Responsibility (CSR) and philosophical moral theories. The objective is to determine which moral theories form the basis for CSR policies. Are they based on ethical egoism, libertarianism, utilitarianism or some kind of common-sense morality? In order to address this issue, I conducted an empirical investigation examining the relation between moral theories and CSR policies, in companies engaged in CSR. Based on the empirical data I collected, I start by suggesting some (...) normative arguments used by the respondents. Secondly, I suggest that these moral arguments implicitly rely on some specific moral principles, which I characterise. Thirdly, on the basis of these moral principles, I suggest the moral theories upon which the CSR policies are built. Previous empirical studies examining the relation between philosophical moral theories and the ethical content of business activities have mainly concentrated on the ethical decision-making of managers. Some of the most prominent investigations in that regard propose that managers mainly act in accordance with utilitarian moral theory (Fritzsche, D. J. and H. Becker: 1984 , Academy of Management Journal 27 (1), 166–175; Premeaux, S. and W. Mony: 1993 , Journal of Business Ethics 12 , 349–357; Premeaux, S.: 2004 , Journal of Business Ethics 52 , 269–278). I conclude that CSR policies are not based on utilitarian thinking, but instead, on some kind of common-sense morality. Inspireret af filosoffen Søren Kierkegaards stadieteori karakteriserer Harald Høffding humoren som et etisk standpunkt, der nægter at anerkende den kristnes tragiske syn på livet. I stedet formår humoristen, at balancere livets lyse og skyggefulde sider. Humoristen lever sit liv med åbne øjne og har derfor blik for såvel verdens komik som (...) tragik. Harald Høffding (1843-1931) var teolog og filosof og virkede gennem 30 år som professor ved Københavns Universitet. I løbet af sin karriere opnåede han en central position i det danske videns- og kulturliv og nød stor anerkendelse både i og udenfor Danmark. Høffding var yderst virksom hele sit liv, og tankegodset i hans bøger er stadig relevant i dag. Giving the foundation of his doctrine of the “Umwelten” v.Uexküll considersKants idealism as the best starting point. The present essay, to the contrary, tries to demonstrate, that the peculiarity of his problems rather corresponds to the logical and metaphysical position ofLeibniz's “monadology” and so shares its philosophical profundity as well as its ontological difficulties. Cardinal points of this correspondence are the following: 1) There is a plurality of subjective worlds=“Umwelten”=“monads”. 2) They are completely isolated one from another. 3) The subject (...) bilds up its reality quite autonomically according to an ideal and specific law=plan=conception. 4) The individual vital laws harmonize according to an optimal general plan. 5) The objective space is denied and regarded as the formalized system of living subjective centres=points of view. 6) Therefrom results the difficulty of explaining a causality of inconscious nature, which is independent from the subject. 7) From this follows the necessity of speculatively amplifying the conception of “subject” or “monad” as well as finally displacing the problem of reality into the metaphysical-religious sphere of a supreme monad or subject.En donnant les raisonnements de sa doctrine des „Umwelten”, M. v.Uexküll considère l'idéalisme deKant comme le meilleur point de départ. In 1922, Aleksander Birkenmajer presented an unknown work of Albert of Saxony, Quaestiones de sphaera, in a manuscript at the Dominicans in Vienna. In 1989, Jürgen Sarnowsky found a second manuscript in Rome. This paper presents a third complete manuscript (BNE Madrid) and an incomplete one (Amploniana Erfurt) of this work. Furthermore, it is argued that an anonymous expositio of Sacrobosco’s treatise can be ascribed to Albert of Saxony. Finally, an anonymous commentary on Albert’s questions in two manuscripts (Munich, Salzburg) (...) is presented. The possibility that this commentary stems from the famous Viennese master John of Gmunden (d. 1442) is considered, but no decisive result could be achieved yet. Jahrhundert und die Philosophiegeschichte eingebettet ist. Die vornehmlich von Marx und Engels verfasste Schrift ist gleichermaßen Gedankenlaboratorium, polemische Streitschrift und der Beginn der Dogmatisierung. Diese Schwellensituation macht den anhaltenden Reiz der Schrift aus, in der eine Vielzahl von systematischen und methodischen Fragen diskutiert und variiert werden. Das unvollendete Werk hat eine eigentümliche Editionsgeschichte und bis heute steht die Publikation (...) in der MEGA aus. Der Band in der Reihe "Klassiker Auslegen" ist international der erste Versuch, das Werk als Ganzes und in seiner Widersprüchlichkeit zu thematisieren und zu kommentieren. In der "Deutschen Ideologie" betreiben Marx und Engels eine "Aufhebung bzw. Verwirklichung der Philosophie" in positiver Wissenschaft und das Werk steht im Kontext der beginnenden Ausdifferenzierung von Sozialwissenschaften aus der umfassenden praktischen Philosophie Hegels. Aus heutiger Sicht kann man dies sowohl als philosophisch inspirierte Gesellschaftstheorie begreifen, wie auch als eine politische Philosophie, deren Kern eine Kritik an der "bürgerlichen" Auffassung von Politik ist. Der Text gewährt Einblicke, in den Prozess der Formierung einer neuartigen Form von Makrotheorie, wobei sich neben dem klassentheoretisch-kollektivistischen, individualistische, philosophisch-normative und positivistische Ansätze in ihr finden. Solche Spannungen werden in den Kommentaren ausgelotet und in ihrer Widersprüchlichkeit diskutiert. 90 Jahre nach der Erstpublikation von Heideggers Hauptwerk Sein und Zeit rekonstruieren die verschiedenen Beitrage des Bandes den fundamentalontologischen Denkansatz im Horizont der Philosophie der Moderne ebenso wie der abendlandischen Metaphysik und nicht zuletzt im Zusammenhang von Heideggers Denkweg. Wie wenige Werke der Philosophie entfaltet Heideggers chef d'oeuvre noch immer eine ungebrochene Faszination. In den Aufsatzen verbinden sich unterschiedliche Zugange zu Heideggers Werk, von der Phanomenologie uber die philologisch-textimmanente Interpretation bis zu Verfahrensweisen der analytischen Philosophie. Sie lassen sich daher als (...) reprasentativer Querschnitt heutiger auf dessen Denken konzentrierter Heidegger-Forschung verstehen. Innen- und Aussenperspektiven erganzen einander dabei fruchtbar. Die in Sein und Zeit exponierten und entwickelten Phanomene und Begriffe werden gleichermassen sowohl in ihrer immanenten Bedeutungsstruktur wie auch in ihren Kontexten und ihrer systematischen Relevanz analysiert. Par exemple, les travaux de recherche conduits jusqu’à présent autour du terme « occidentalisme » sont peu nombreux et se cantonnent souvent à accorder la primauté aux questions liées aux phénomènes d’acculturation coloniale et postcoloniale. Aussi, il nous paraît important de dépasser cette façon restrictive de poser les problèmes et (...) d’essayer de comprendre quelles sont les vraies questions qui se cachent derrière les processus d’élaboration et de signification de ces deux termes. Car les cultures orientales elles-mêmes, présentent des formes les plus diverses, les plus adaptées et les plus intégratrices qui soient, aussi bien sur le plan cognitif que dans leurs représentations dans l’art. Ces cultures ont su intégrer les idéaux de l’Occident et de l’antiquité, sans aucune contrainte. On peut ainsi en retrouver des traces à travers l’exemple de l’imaginaire du paradis et de ses descriptions ou celui de la représentation des images de potentats autoritaires et tyranniques. Dans cet article, nous décrivons un schéma et des modèles de représentation développés pour structurer les corpus de communication médiée par ordinateur (CMC) en suivant les recommandations de la Text Encoding Initiative (TEI). Nous considérons le discours CMC comme un échange dialogique entre humains, organisé de manière séquentielle. Nous insistons d’abord sur le fait que de nombreuses caractéristiques de la CMC ne sont pas traitées de manière adéquate par les schémas et les outils actuels d’encodage de corpus. Nous formulons donc (...) un ensemble de recommandations pour représenter la CMC avec des schémas d’encodage, en insistant sur le fait que la TEI nous semble être un cadre particulièrement approprié pour l’encodage des corpus CMC. Nous proposons une modélisation des unités de base de la CMC (énoncés, messages et actions non verbales) ainsi que des structures de niveaux macro- et micro des interactions dans les environnements de la CMC. À partir de ces modèles, nous introduisons le CMC-core, un noyau TEI pour l’encodage des corpus CMC, qui définit un ensemble de traits d’encodage spécifiques à la CMC sur quatre niveaux: (i) éléments, (ii) classes de modèles, (iii) classes d'attributs et (iv) modules de l'infrastructure TEI. La description du noyau proposé est illustrée au moyen d’exemples extraits des corpus des chercheurs du groupe SIG TEI CMC, représentant une grande variété de genres de la CMC (le chat, le wiki talk, le tweet, le blog, les interactions Second Life…). Le matériel décrit, i.e. les schémas, les exemples d’encodage et la documentation, est disponible sur le Wiki du SIG CMC TEI et accompagnera une demande d’enrichissement de la TEI (TEI feature request) au conseil de la TEI à la fin de l’année 2019. Hans Primas' in terests ha (...) ve covered an enormous range: metho ds and instruments for n uclear magnetic resonance, theoretical c hemistry , C - and W -algebraic formulations of quantum mechanics, the measurement problem and its various implications, holism and realism in quantum theory , theory reduction, the w ork and p ersonality of Wolfgang Pauli, as well as Jungian psychology . In man y of these elds he provided imp ortan t and original fo o d for though t, in some cases going far b eyond the ev eryda y business in the scientic world. As is the case with other scien tists who are conceptually innov ativ e, Hans Primas is read more than he is quoted. His in uence is due to his writings. Even with the current ood of publications, he still p erforms the miracle of ha ving scientists eagerly a waiting his next publication. His external life, by wa y of contrast, is not very sp ectacular. With the exception of a brief p erio d as a guest professor at Washington Univ ersity at St. Louis, he has never b een a wa y from Zuric h for an y length of time. He has nev er b een a warded an y prizes, nev er organized a congress, nev er done any organizational work in a scientic so ciety . Second, it is suggested that the Report is confused about the concept of paternalism. Third, it is argued that the discussion of the concept of stewardship is lacking in detail and substance. Sartre's reading of Harald Höffding's works was instrumental in his critical reception of Spinoza. One may find traces of Höffding's critical monism in Sartre's Being and Nothingness . Höffding had formulated his critical monism in order to remedy what he perceived to be problems in Spinoza's view. Sartre's critique of Spinoza aligns with that of Höffding. Moreover, Höffding's influence on Sartre goes well beyond the reception of Spinoza. Indeed, the young Sartre's interest in Bergson, psychology and questions relative to (...) the totality of Being could have followed from his reading of Höffding. In fact, the way in which Höffding tackles questions about the soul, the world, and God illuminates the timid proposals offered by Sartre in the conclusion of Being and Nothingness. Thus, understanding Höffding French Cet article démontrera que la réception critique de Spinoza par Sartre est influencée par sa lecture des oeuvres de Harald Höffding. Une lecture attentive permet d'identifier des traces du monisme critique de celui-ci dans L'être et le néant . Ce monisme critique avait été formulé afin de pallier aux problèmes perçus par Höffding chez Spinoza. Or, cette même critique se retrouve chez Sartre. De plus, cet article fera aussi la démonstration que l'influence de Höffding sur Sartre va au-delà de la réception de Spinoza. En effet, l'intérêt du jeune Sartre pour Bergson, la psychologie et les questions relatives à la totalité de l'Être pourraient être le résultat de sa lecture de Höffding. We perceive smells as perduring complex entities within a distal array that might be conceived of as smellscapes. However, the philosophical orthodoxy of Odor Theories has been to deny that smells are perceived as having a distal location. Recent challenges have been mounted to Odor Theories’ veracity in handling the timescale of olfactory perception, how it individuates odors as a distal entities, and their claim that olfactory perception is not spatial. The paper does not aim to dispute these criticisms. Rather, (...) what will be shown is that Molecular Structure Theory, a refinement of Odor Theory, can be further developed to handle these challenges. The theory is further refined by focusing on distal perception that requires considering the perceptual object as mereologically complex persisting odor against a background scene conceived of as a smellscape. What will be offered is an expansion of Molecular Structure Theory to account for distal smell perception within natural environments. (shrink)

When it originated in the late 19th century, psychometrics was a field with both a scientific and a social mission: psychometrics provided new methods for research into individual differences, and at the same time, these psychometric instruments were considered a means to create a new social order. In contrast, contemporary psychometrics - due to its highly technical nature and its limited involvement in substantive psychological research - has created the impression of being a value-free discipline. In this article, we develop (...) a contrasting characterization of contemporary psychometrics as a value-laden discipline. We expose four such values: that individual differences are quantitative (rather than qualitative), that measurement should be objective in a specific sense, that test items should be fair, and that utility of a model is more important than its truth. Our goal is not to criticize psychometrics for employing these values, but rather to bring them into the open and to show that these values are not inevitable and are in need of systematic evaluation. We are immersed within an odorous sea of chemical currents that we parse into individual odors with complex structures. Odors have been posited as determined by the structural relation between the molecules that compose the chemical compounds and their interactions with the receptor site. But, naturally occurring smells are parsed from gaseous odor plumes. To give a comprehensive account of the nature of odors the chemosciences must account for these large distributed entities as well. We offer a focused review of (...) what is known about the perception of odor plumes for olfactory navigation and tracking, which we then connect to what is known about the role odorants play as properties of the plume in determining odor identity with respect to odor quality. We end by motivating our central claim that more research needs to be conducted on the role that odorants play within the odor plume in determining odor identity. (shrink)

In Nicomachean Ethics X.7–8, Aristotle defends a striking view about the good for human beings. According to Aristotle, the single happiest way of life is organized around philosophical contemplation. According to the narrowness worry, however, Aristotle's contemplative ideal is unduly Procrustean, restrictive, inflexible, and oblivious of human diversity. In this paper, I argue that Aristotle has resources for responding to the narrowness worry, and that his contemplative ideal can take due account of human diversity.

The World Medical Association's Declaration of Helsinki is one of the most important and influential international research ethics documents. Launched in 1964, when ethical guidance for research was scarce, the Declaration comprised eleven basic principles and provisions on clinical research. The document has since evolved to a complex set of principles, norms, and directions for action of varying degrees of specificity, ranging from specific rules to broad aspirational statements. It has been revised six times in an effort to maintain its (...) influence. While all revisions were the result of vigorous debate, the 2000 revision and two subsequent notes of clarification spurred particular controversy surrounding the use of placebo in clinical research and the standard of care and post-trial obligations in research in developing countries. Several institutions opted to cite earlier versions of the Declaration, and the U.S. Food and Drug Administration recently removed all reference to the Declaration in its approval requirements for drugs and biological products that are studied outside the United States. Tog statsministeren personligt ansvar for sin egen, svære beslutning, eller var hun en hykler? I denne videnskabeligt funderede debatbog sætter Silas F. Harrebye vores allesammens hykleri under lup. First collected in Italy in 1985, _Art's Claim to Truth_ is considered by many philosophers to be one of Gianni Vattimo's most important works. Newly revised for English readers, the book begins with a challenge to Plato, Aristotle, Kant, and Hegel, who viewed art as a metaphysical aspect of reality rather than a futuristic anticipation of it. Following Martin Heidegger's interpretation of the history of philosophy, Vattimo outlines the existential ontological conditions of aesthetics, paying particular attention to the works of (...) Kandinsky, which reaffirm the ontological implications of art. Vattimo then builds on Hans-Georg Gadamer's theory of aesthetics and provides an alternative to a rationalistic-positivistic criticism of art. This is the heart of Vattimo's argument, and with it he demonstrates how hermeneutical philosophy reaffirms art's ontological status and makes clear the importance of hermeneutics for aesthetic studies. In the book's final section, Vattimo articulates the consequences of reclaiming the ontological status of aesthetics without its metaphysical implications, holding Aristotle's concept of beauty responsible for the dissolution of metaphysics itself. In its direct engagement with the works of Gadamer, Heidegger, and Luigi Pareyson, _Art's Claim to Truth_ offers a better understanding of the work of Vattimo and a deeper knowledge of ontology, hermeneutics, and the philosophical examination of truth. In Plato’s Symposium, the mysterious Apollodorus recounts to an unnamed comrade, and to us, Aristodemus’ story of just what happened at Agathon’s drinking party. Since Apollodorus did not attend the party, however, it is unclear what relevance he could have to our understanding of Socrates’ speech, or to the Alcibiadean “satyr and silenic drama” (222d) that follows. The strangeness of Apollodorus is accentuated by his recession into the background after only two Stephanus pages. What difference—if any—does Apollodorus make to the (...) Symposium? Does his inclusion call the dramatic and philosophical unity of the work into question? I argue that despite initial appearances, Plato has important philosophical reasons for including Apollodorus as a character. Far from being an odd appendage to an otherwise complete narrative, the figure of Apollodorus is useful for our understanding of Socrates’s conception of eros later in the work. (shrink)

There is increased interest in deviant behavior in the workplace. However, research is lacking on the moral economy of such behavior. Moral economy is particularly important in contexts where syncretic forces impinge on deviant behavior. Consequently, we use moral economy reasoning to examine the relationship between ethnic obligation and deviant behavior in the African context. In Study 1, data (_N_ = 27, 148) show an inverted U-shape effect of meta-agency and deviant behavior. In Study 2, difference-in-difference (DID) analysis of data (...) (_N_ = 25,387 in 2005 and _N _= 51,587 in 2013) shows significant DID effect of meta-agency. Primary data from Study 3 (_N_ = 229) shows a U-shaped effect of agency and deviant behavior. In Study 4 (_N_ = 333), a replication shows support for the U-shape effect in Study 3. The four studies thus show complex patterns that reflect U-shape and inverted U-shape relationships between ethnic obligation and deviant behavior as indicated by bribery, corruption, and unethicality. Robustness checks support the curvilinear relationships suggesting that the effects are not due to chance. We discuss implications for research and practice. (shrink)
